Title — Liber Sextus
Title VI: On Institutions
Chapter I
Although a chapter cannot, while the see is vacant, confer benefices belonging to the bishop's collation, it can nevertheless institute persons presented to them. This states the point. Zenzel.
Boniface VIII.
Although a chapter cannot, while the see is vacant, confer benefices that belong to the bishop's collation, it can nevertheless admit persons presented by patrons, if they are suitable, and institute them in the benefices to which they were presented, although such admission and institution would belong to the bishop if he survived.
Chapter II
Defect of sacred orders does not exclude a person presented. This states the point. Zenzel.
The same, in the same council.
If the person to whom the presentation of a rector in some parish church is known to belong presents to it someone not constituted in sacred orders, we decree that he is to be admitted, provided that he is otherwise suitable and can, within the time established by law, be promoted to the orders that the cure of that church requires.
Non repellit praesentatum defectus sacrorum ordinum. H. d. Zenz.
Idem in eodem *.
Si is, ad quem rectoris praesentatio in aliqua parochiali ecclesia noscitur pertinere, quempiam non constitutum in sacris praesentet ad eam: ipsum, dummodo alias sit idoneus, et infra tempus a iure statutum ad ordines, quos ipsius ecclesiae cura requirit, valeat promoveri, decernimus admittendum.
