Title — Liber Sextus
Title I: On Betrothals and Marriages
Chapter I
Pure and certain betrothals, valid by reason of consent, although otherwise null, induce public honesty, which has the force of dissolving subsequent betrothals, but not preceding ones. — § 1. Conditional betrothals do not induce public honesty before the occurrence of the condition. This states the point. Johannes Andreae.
Boniface VIII.
From pure and certain betrothals, even if they are null by reason of consanguinity, affinity, frigidity, religious profession, or any other reason whatsoever, provided that they are not null from defect of consent, there arises an impediment of the justice of public honesty effective for impeding and dissolving subsequent betrothals or marriages, but not for dissolving preceding ones. Therefore, he who contracted betrothals purely and definitely with one woman and afterward did the same with a second woman who is a blood relative of the first remains bound, by force of the prior betrothals—which are in no way derogated by the justice of public honesty arising subsequently from the second betrothals—to contract marriage with the first.
§ 1. But he who contracted betrothals with a woman under a condition, if afterward, before the occurrence of the condition, he contracts through words of the present with another woman who is a blood relative of the first, ought to remain with the second, since from conditional betrothals before the condition exists, as from betrothals lacking consent and uncertain, no justice of public honesty arises.
