Title — Liber Sextus
Title X: On the Exchange of Property
Chapter I
An exchange can be made notwithstanding expectations of benefices. John Andrew.
Boniface VIII, to the Bishop of Béziers.
Although certain persons in your diocese await by apostolic authority benefices next to become vacant, nevertheless, preferring equity to rigor in this regard, we do not wish those who, desiring to exchange their benefices in the same diocese that belong to your collation according to the form of law, freely and without fraud resign them into your hands to be impeded in any way, on the aforesaid occasion, from making an exchange of benefices of this kind, which otherwise they would by no means have resigned.
DE RERUM PERMUTATIONE.
Non obstantibus exspectationibus beneficiorum permutatio fieri potest.
Ioann. Andr.
Bonifacius VIII. Biterensi Episcopo *.
Licet in tua dioecesi aliqui auctoritate apostolica beneficia proximo vacatura exspectent: illos tamen, qui, secundum formam iuris sua beneficia in eadem dioecesi ad tuam collationem spectantia permutare volentes, libere ac sine fraude in manibus tuis ipsa resignant, nolumus occasione praemissa, (aequitatem praeferentes in hac parte rigori,) circa faciendam permutationem beneficiorum huiusmodi, (quae alias minime resignassent,) ullatenus impediri.
