document — Palmieri, On Christian Marriage

From Another Synod of the Same, in Ireland, in an Uncertain Year

¶1049.

Yet these canons do not seem authentic to the learned. Cf. Dr. Hefele, cited work, tome III, book 12, paragraph 209.

¶1050.

Canon XXV. Let not a brother ascend the bed of a deceased brother, the Lord saying: "They shall be two in one flesh"; therefore the wife of your brother is your sister.

¶1052.

Canon XXVI. Hear the Lord saying: "He who adheres to a harlot is made one body." Likewise: "Let the adulteress be stoned," that is, let her die to this man, so that she cease to grow who does not cease to commit adultery. Likewise: "If a woman was an adulteress, does she return to her former husband?" Likewise, it is not lawful for a man to dismiss his wife except for the cause of fornication; as if He should say: for this cause it is lawful. Hence if he marries another, as after the death of the former (manuscript: or), they do not forbid it.

¶1053.

If you interpret that velut as "just as," a faculty, though wrongly, is created for dissolving the bond because of adultery. Perhaps this published reading or the manuscript reading would suffer another interpretation; but the following Canon XXVII too strongly suggests the obvious interpretation of this one also. These canons, namely, depart from the common doctrine of the Church, which Decree VI of Innocent I to Exuperius, Canon IX of the Council of Elvira, and Canon VIII of the African Council above report. But concerning these canons, as we already warned, it is not necessary for us to be solicitous.

¶1054.

Canon XXVI. What the father wills, let the virgin do (the daughter in contracting nuptials), because the head of the woman is the man (not a sufficiently suitable citation); but the will of the virgin must be sought by the father, since God has left man in the hand of his own counsel.

¶1055.

Canon XXVII. By the same reason first vows and first marriages are to be observed, so that first ones are not made void by second ones, unless they have been adulterated.
