From the Carthaginian or African Council, A.D. 407

¶1039.

Cf. the Council commonly called African, in which the Canons of the earlier Synods are reported and confirmed. There, from Canon LXII, begin the Canons of the Council held in the year 407, whence our canon is the eighth. Thus in the collection of Councils, tome 3, from page 497 and following, compared with page 101, edition of Labbe and Coleti. But in Dionysius, in the Code of African Canons, this Synod of which we speak begins from Canon XCV. Twelve canons are attributed to this Synod. The Fathers Ballerini agree with all these things, On the Ancient Collections, part II, chapter III, section 6, n. 6.

¶1040.

Canon VIII. It pleased the council that, according to evangelical and apostolic discipline, neither a man dismissed from his wife nor a woman dismissed from her husband be joined to another; but let them remain thus or be reconciled to one another. But if they have contemned this, let them be reduced to penance. In which cause an imperial law must be sought to be promulgated.
