document — Palmieri, On Christian Marriage

From the Council of Girona, in Spain, A.D. 1068

¶1601.

Canon III. By excommunicating they sanctioned that incestuous persons be separated in every way; then let them have license of entering a better marriage.

¶1602.

These Fathers removed in their own province the impediment of incest prohibiting marriage. Cf. the Decrees of Nicholas I in this matter.

¶1603.

Canon IV. Let those who have dismissed their wives and accepted others recover their own, if they are alive, and dismiss the foreign women. And unless they have done this, let both the incestuous and these be so excommunicated that none of the Christians says "hail" to them, etc.

¶1604.

Canon VII. From presbyter down to subdeacon, if they have led a wife or retained a concubine, let them go out from the clergy and lose every ecclesiastical benefice, and remain in the Church with the laity. But if they have been disobedient, let them incur the sentence concerning the incestuous.

¶1605.

Namely, no marriage of these men was held valid, just as none of the incestuous. Cf. Canon IV of the Council of Troyes.
