Article III: Of Synodal Examiners and Pastor Consultors
Superseded as law in 1983 — read why this Code still matters. Each canon links to its 1983 counterpart.
§ 1. In every diocese there are to be synodal examiners and pastor consultors, all of whom are to be constituted in the Synod, proposed by the Bishop, approved by the Synod.
§ 2. As many are to be chosen as the Bishop in his prudent judgment shall have judged necessary, yet not fewer than four nor more than twelve.
§ 2. Tot eligantur quot Episcopus prudenti suo iudicio necessarios iudicaverit, non tamen infra quatuor, nec ultra duodecim.
§ 1. When examiners and pastor consultors have died in the intermediate time between one Synod and another, or have ceased from the duty for another reason, the Bishop is to substitute other pro-synodal ones with the counsel of the cathedral Chapter.
§ 2. The same rule is also to be observed in constituting examiners and pastor consultors whenever a Synod is not held.
§ 1. Examiners and pastor consultors, whether constituted in the Synod or outside the Synod, fall from office after ten years from the beginning of the duty, or even sooner when a new Synod arrives; they can nevertheless bring to completion a business already begun and, with the things to be observed by law having been observed, be constituted again.
§ 2. Those who are constituted in place of examiners and pastor consultors who are lacking persist in office only as long as those for whom they were substituted would have persisted.
§ 2. Qui loco examinatorum ac parochorum consultorum deficientium constituantur, in officio persistunt dumtaxat quousque perstitissent ii quibus substituti fuerunt.
They cannot be removed by the Bishop except from a grave cause and with the counsel of the cathedral Chapter.
§ 1. Synodal examiners are diligently to devote their work especially to holding tests for the provision of parishes, and also to the processes of which in can. 2147 and following.
§ 2. For holding tests for the ordination of clerics and the approval of priests who seek the faculty of hearing sacramental confessions or of holding sacred sermons, and for the examinations of which in can. 130, it is open to the Bishop to use either the work of synodal examiners or of others.
The same person can be an examiner and pastor consultor, but not in the same case.
