Article II: Of Judging the Validity of the Apostolic Process
Superseded as law in 1983 — read why this Code still matters. Each canon links to its 1983 counterpart.
Once the apostolic process has been remitted to the Sacred Congregation, first of all it must be established concerning the validity of the same process, and at the same time the validity of the informative process is to be recalled to examination.
Processu apostolico ad Sacram Congregationem remisso, in primis de eiusdem processus validitate constare debet, simulque ad examen revocetur validitas processus informativi.
Wherefore before discussion, a position is to be prepared by the advocate of the cause, which consists of:
1° An information by which, the documents necessary for the matter contained in the process having been produced, it is demonstrated that all things in it were carried out according to the norm of law.
2° Observations of the Promoter General of the Faith against validity, with the responses of the advocate, each drawn up according to the norm of can. 2080.
Quare ante disceptationem paretur a causae advocato positio, quae constet:
1° Informatione qua, productis documentis ad rem necessariis in processu contentis, omnia in eo ad normam iuris peracta fuisse demonstretur;
2° Animadversionibus Promotoris generalis fidei contra validitatem, cum responsionibus advocati, utrisque ad normam can. 2080 exaratis.
§ 1. For judging the validity of the process, a congregation is to be held, with the Cardinal Prefect of the Sacred Congregation, the Cardinal Ponens, and three other Cardinals of the same Sacred Congregation chosen by the Roman Pontiff himself present, and also the Secretary, the Apostolic Protonotary, the Promoter General of the Faith, and the Sub-promoter.
§ 2. In the congregation, with the Cardinal Ponens reporting, the aforesaid prelates bring forth their vote; and the Promoter General of the Faith proposes objections, if he has any.
§ 3. All these things having been discussed, the Cardinal Fathers are to render judgment; and if it has been favorable and confirmed by the Supreme Pontiff, a decree concerning the validity of the process is to be made.
§ 2. In congregatione, referente Cardinali Ponente, praelati supradicti suum votum proferunt; et Promotor generalis fidei obiectiones, si quas habet, proponit.
§ 3. His omnibus discussis, Patres Cardinales iudicium ferant; quod si fuerit favorabile et a Summo Pontifice confirmatum, decretum de processus validitate fiat.
