The tribunal of appeal must be constituted in the same manner as the tribunal of first instance; and the same rules, adapted to the matter, are to be observed in the discussion of the cause.
Tribunal appellationis eodem modo quo tribunal primae instantiae constitui debet; et eaedem regulae, accommodatae ad rem, in causae discussione servandae sunt.

If a cause was heard collegially in first instance, also in the grade of appeal it must be defined collegially and not by a smaller number of judges.
Si collegialiter causa in prima instantia cognita fuerit, etiam in gradu appellationis collegialiter nec a minore iudicum numero definiri debet.
