Chapter — Vermeersch, Theologia Moralis
Title V: The Time and Place of Marriage
— I. Time. "Marriage can be contracted at any time of the year" (c. 1108, §1).
Before the Code, the laudable customs of provinces which prohibited marriages themselves during closed time seemed to Trent to have to be preserved. Now they will not be able to be preserved unless the Ordinaries of places judge that the same cannot prudently be removed.
Today, as was said above, n. 800, only the solemn blessing is prohibited of itself, and the time which before ran from Advent to Epiphany inclusive, and from Ash Wednesday to the octave of Easter, now has its end with the Nativity of the Lord and Easter (c. 1108).
— II. "The place is the parochial church; in another church or public or semi-public oratory it cannot be celebrated except by license of the local Ordinary or pastor; for it to be celebrated in private buildings there is required an extraordinary case, a just and reasonable cause, and the license of the local Ordinary. In churches or oratories, whether of seminaries or of religious women, Ordinaries are not to permit this except with urgent necessity and with opportune cautions applied" (c. 1109, §§1 and 2).
Mixed marriages are to be celebrated outside the church unless the Ordinary prudently judges that this cannot be observed without graver evils arising (c. 1109, §3).
Summary
— I. By force of common law, marriage can be celebrated at any time of the year.
II. The place is the parochial church. Elsewhere license of the local Ordinary or pastor is needed.
