Scholion. On the Privileges of Religious

1268.

I. Religious, even lay religious and novices, enjoy the privileges of clerics (can. 614); but concerning these there was discussion in n. 1153.

II. Moreover regulars, novices not excluded,1 whether men or women, with their houses and churches, except those nuns who are not subject to regular Superiors, are exempt from the jurisdiction of the local Ordinary, except in cases expressed by law (can. 615). Nevertheless a house that is not formed remains under the special vigilance of the local Ordinary, who, if abuses have crept in and have been a scandal to the faithful, can provide in the meantime by himself (can. 617, § 2).

III. Religions of simple vows do not enjoy the privilege of exemption unless it has been specially granted to them (can. 618, § 1), as it has been granted to the Redemptorists and Passionists.

1 Postulants are excluded.
