causa — Decretum of Gratian
Causa XII
GRATIAN. Certain clerics wish to relinquish their own property; they make testaments concerning their own property and that of the church; they bestow certain things from the property of the church. (Qu. I.) First it is now asked whether clerics are permitted to possess property of their own. (Qu. II.) Second, whether the property of the church which was given by them can possess any validity for those who received it. (Qu. III.) Third, if before the time of their ordination they appeared to possess nothing and after ordination are known to have acquired certain things, whether they can leave those things to whomever they wish or not. (Qu. IV.) Fourth, if they are known to have acquired certain things from their own property and that of the church, whether by right they accrue to both in common or separately to the church or the priest. (Qu. V.) Fifth, whether they are permitted to make testaments.
GRATIANUS. (Qu. III.) Tertio, si ante tempus suae ordinationis, qui nichil habere uidebantur et post ordinationem aliqua inuenisse noscuntur, an possint ea quibus uoluerint, relinquere an non? (Qu. IV.) Quarto, si de suis et ecclesiae rebus aliqua acquisisse noscuntur, an utrique communiter, an singulariter ecclesiae uel sacerdoti iure proueniant? (Qu. V.) Quinto, si testamenta eis liceat conficere?
