causa — Decretum of Gratian
Causa IX
GRATIAN. A certain archbishop marked by a sentence of excommunication ordained several clerics of another metropolitan; he deposed a certain chaplain of his suffragan without consulting him and ordained another in his place. (Qu. I.) It is asked whether an ordination performed by excommunicated persons can in any way be held valid. (Qu. II.) Second, whether a bishop, archbishop, primate, or patriarch is permitted to ordain the clerics of another without their proper letters. (Qu. III.) Third, whether an archbishop can condemn the clerics of his suffragan without consulting him or absolve those condemned.
GRATIANUS. Sententia excommunicationis notatus quidam archiepiscopus aliquot clericos alterius metropolitani ordinauit; quendam capellanum sui suffraganei illo inconsulto deposuit, atque alium in loco eius ordinauit. (Qu. I.) Queritur, an ordinatio, que ab excommunicatis facta est, aliquo modo possit rata haberi? (Qu. II.) Secundo, an liceat episcopo, archiepiscopo, primati uel patriarchae clericos alterius sine litteris propriis ordinare? (Qu. III.) Tertio, an archiepiscopus clericos suffraganei sui illo inconsulto dampnare ualeat, uel dampnatos absoluere?
