CASE XXXIII.

GRATIAN. A certain man, impeded by acts of magic, could not render the marital due to his wife. Meanwhile, another man secretly corrupted her; separated from her husband, she publicly marries her corrupter. The crime she had committed she confesses to God only in her heart. The faculty of knowing her is restored to this man; he seeks his wife again. After receiving her, so that he might more readily devote himself to prayer and approach the flesh of the Lamb in purity, he promised that he would preserve continence; but his wife did not give her consent. (Q. I.) It is asked whether, because of the impossibility of intercourse, a woman is to be separated from her husband. (Q. II.) Second, whether, after the separation, she can marry the man with whom she had previously fornicated. (Q. III.) Third, whether a crime can be blotted out by confession of the heart alone. (Q. IV.) Fourth, whether someone can render the marital due during a time of prayer. (Q. V.) Fifth, whether a man can vow continence without his wife’s consent, or whether he can extort from her by threats or terrors permission to vow.
