causa — Decretum of Gratian
Causa XVIII
GRATIAN. A certain abbot who was consecrated as bishop had previously conferred much upon his monastery and afterward acquired more in the episcopate. When the brothers sought a successor for him, the bishop of the place wished to insert himself into the election so that through him an abbot might be ordained in the monastery; the brothers resisted. (Question I.) It is asked whether the monastery can seek the things acquired by the bishop, and whether the episcopal church can claim for itself the things that had been handed over to the monastery. (Question II.) Second, whether the abbot is to be elected and ordained by the bishop, or is to be instituted only by his own brothers.
GRATIANUS. Quidam abbas consecratus in episcopum prius monasterio multa contulit, postea in episcopatu plura acquisiuit; cui dum fratres successorem quererent, episcopus loci semet electioni uolebat inserere, ut per ipsum abbas in monasterio ordinaretur; fratres renituntur. (Qu. I.) Queritur, an monasterium possit petere que ab episcopo acquisita sunt? an episcopalis ecclesia possit sibi uendicare que monasterio fuerant contradita? (Qu. II.) Secundo, an per episcopum abbas sit eligendus et ordinandus, an tantummodo a propriis fratribus sit instituendus?
