causa — Decretum of Gratian
Causa XIII
GRATIAN. Certain parishioners of a baptismal church, oppressed by the calamities of wars and compelled by fear of the enemy, transferred their domiciles into another diocese, yet they did not cease to cultivate their old estates; they began to pay tithes to that church into whose diocese they passed, and they chose their places of burial at it. After fifty years had elapsed, the clerics to whom they had formerly paid tithes began to raise a question against those who receive first fruits and tithes from these persons; they come to trial. (QUESTION I.) First it is asked whether those whose domiciles are in the diocese of this baptismal church ought to pay tithes and celebrate their obsequies at that church in which these things were formerly done by their parents. (QUESTION II.) Second, whether the right of receiving tithes and conducting funerals is removed by prescription of time.
GRATIANUS. (Qu. I.) Modo primum queritur, si illi, quorum domicilia sunt in diocesi huius baptismalis ecclesiae, an debeant persoluere decimas, et celebrare suas exequias apud eam ecclesiam, in qua quondam hec fiebant a parentibus eorum? (Qu. II.) Secundo, an prescriptione temporis ius percipiendi decimas et funerandi tollatur?
