causa — Decretum of Gratian
Causa XXV
GRATIAN. The holy Roman Church fortified a certain baptismal church with its privileges, assigning to it in full the tithes of its diocese. It likewise fortified a certain monastery with its own privileges, decreeing that it should pay tithes to no one from its own estates. It therefore happened that within the diocese of the fortified baptismal church the aforesaid monastery acquired estates for itself, some by purchase and others by donation. A dispute therefore arises between the monks and clerics concerning the tithes. (Question I.) First it is now asked whether the clerics of the baptismal church can claim for themselves in full the tithes of their diocese by the authority of the privilege. (Question II.) Second, whether the later privilege of the monks derogates from the earlier privileges of the baptismal churches.
GRATIANUS. Sancta Romana ecclesia quandam baptismalem ecclesiam suis muniuit priuilegiis, decimationes suae diocesis ex integro sibi attribuens. Item quoddam monasterium similiter muniuit priuilegiis propriis, decernens, ut ex propriis prediis nulli decimas persolueret. Accidit itaque, ut intra diocesim premunitae baptismalis ecclesiae prefatum monasterium alia emptione, alia donatione predia sibi inueniret. Oritur itaque contentio inter monachos et clericos de decimis. (Qu. I.) Nunc primum queritur, an clerici baptismalis ecclesiae auctoritate priuilegii decimas suae diocesis ex integro sibi ualeant uendicare? (Qu. II.) Secundo, an subsequenti priuilegio monachorum derogetur antiquioribus priuilegiis baptismalium ecclesiarum?
