Disputation — Bontempi, Palladium Theologicum V · from Schola Thomistica

Disputation X: On Emphyteusis, Letting, Hiring, and the Fief

English · Latin · Both

1.

EMPHYTEUSIS is manifold; For one kind is given indefinitely, no mention of time being made, and is called Perpetual; Another is given for certain fixed generations, and is called temporal. Likewise it is either Ecclesiastical, or Secular, according to the diversity of Dominion; New, or Old, according to the variety of time, in which it is newly instituted, or renewed. There is also an Emphyteusis hereditary simply, hereditary mixedly, and familial; and this diversity arises by reason of the persons for whom it is granted; This division having been assigned, it is asked what Emphyteusis properly is; afterwards we shall treat also of the other contracts noted in the title.
