Question XIII: Whether princes can grant license to kill outlaws

English · Latin · BothHide topicsShow topics

1.

On this I find only this in St. Bonaventure, serm. 6. on the Decalogue: that ministers of justice can kill the impious, provided it be done from zeal for justice, not from appetite for vengeance.

2.

But they ask: Whether they can then be treacherously killed. Decius affirms, cap. Quae in Ecclesiarum, de constitut. num. 14; Bossius in pract. under the title of the banished.

3.

Mantua denies it, consil. 100; so too Angelus, Lex, final, Cod. de delator; Alexander in the postilla on Bartolus on the same final Lex.

4.

Whatever may be the case concerning these, in whom this second opinion seems to be to be held for the soul's salvation of that wretched man; yet if anyone had given his faith to a banished man that he would not harm him, and then killed him, he would deserve the extreme punishment, as Julius Clarus asserts, L. 5. sentent. §. Homicidium, num. 61, and Fagundez, Book 5, cap. 16, num. 12.
