Question XI: On the other spiritual punishments of heretics

English · Latin · Both

1.

Card. Lugo, disp. 23, sect. 4, Fagundez, and Suarez, at the places cited, enumerate THESE.

2.

THE FIRST is, that they be not buried in sacred ground: cap. Quicunque, de haeret. in 6. Yet Suar., de Cens., disp. 12, sect. 4, num. 13; Coninch., disp. 14, dub. 8, mem. 64; Hurtad., disp. 76, sect. 1, subsect. 1; Lugo, disp. 14, sect. 5, §. 5, num. 159, understand this text of those alone condemned by sentence. Whence he infers that now the Church is polluted only by the burial of those to be avoided.

3.

The SECOND punishment is irregularity. See Sanch., lib. 1, cap. 15; Suar., disp. 21, sect. 5, and disp. 43, de Cens., sect. 1; Diana, 2. p., tract. 1, misc. R. 24, and others as reported by these.

4.

Yet others judge it probable that the occult heretic is not irregular. Diana reports them, p. 1, supr. R. 114, and 2. p. supra, resol. 24, and p. 4, tract. 1, de Irreg., resol. 46.

5.

The third punishment is infamy: cap. Excommunicamus, l. §. Credentes, and cap. Statuimus, eodem tit. de haeret. in 6, and cap. Infames, 6. quaest. 1, and Authent. Gazaros, C. de haeret. initio, and L. Cunctos populos, de Summa Trin. See Suar., disp. 21, sect 5.

6.

The fourth punishment is, that the heretic be deprived of benefices and offices acquired, and be rendered incapable of future ones. See Lugo, disp. 23, sect. 4, §. 2.
