Question XIII: Whether every religious is bound to all the counsels

English · Latin · Both

1.

I ASSERT that he is not held. So St. Thom. here, and St. Bonavent. ad cap. 1. Regulae Minorum.

2.

It is PROVED from the Holy Doctors: A Religious professes a singular institute, and in it not all the counsels are commanded, but three, which fall under vows, and some others, which are found in certain singular institutes: But he is not held except by the force of the law, without which there is no new sin. With this argument work Valentia disp. 10. quaest. 4. punct. 4. Caiet. ad D. Thom. Sylvest. verb. Relig. 1. num. 5.

3.

HENCE St. Bonav. deduces that the Friars Minors are not held to all the counsels of the Gospel, even though the Rule begins thus: Regula Fratrum Minorum haec est, scilicet Domini nostri Iesu Christi Evangelium observare; for it is immediately broken and determined as to what of the Gospel it obliges, saying: Vivendo in obedientia, sine proprio, et castitate. The Saintly Doctor confirms it, for in the course of the rule the holy Father Francis places many things which he professes and declares to enjoin not by commanding but by exhorting, as all the expositors note and decree, Nicolaus III. and Clem. V. in their declarations.
