Doubt I: Whether the goods of fortune are to be restored in the same way

English · Latin · Both

1.

It is certain, and beyond controversy, that goods of fortune, the same ones, if they exist, even if consumable by use, are to be restored as the same in number, unless perhaps thereby a hidden sin of the sinner would be made manifest, or some great inconvenience would follow, as Valentia quaest. 6. puncto 5. §. 1. Navarre in the Manuali, cap. 17. num. 24. notes; or unless the creditor is content with another thing, as is found in Leg. eum a quo, and Leg. manifesti, Cod. de solut.

2.

But if the thing no longer exists, satisfaction ought to be made in equivalent. And if the thing is consumable by use, it ought to be restored as the same, if it exists; or another of the same species, and equally good; or in money. Nor is the thing only owed, but also the fruits of the thing, as the Sainted Bonaventure 3. dist. 37. dub. 7. says; and I have said enough about these also above.
